Interpretation

"Attacker" or "you" or "your" means the person, firm or company placing any order and completing the payment card transaction, or by any other means of payment, with us. "Products" means equipment or other products which The Punch Clinic is to supply in accordance with these Terms and Conditions. "Website" means the ThePunchClinic.com website at www.ThePunchClinic.com

Price of the Goods

All prices on this web site are updated regularly to reflect the varying market value. This means prices may fall as well as rise from day to day. However, we reserve the right to increase our prices without prior notice to reflect any increase in our costs which is due to factors beyond our control. The prices of the products you order are to be those prices as displayed at the moment of transmission of your order, save in respect of special orders and non-standard products (see below). Where appropriate all prices will be displayed in pounds Sterling and include UK Value Added Tax at 17.5%. This is subject to alteration, when enforced, without notice. Please refer to individual prices. Postal charges are added to the prices of the products ordered prior to transaction completion. Such charges are calculated on a sliding scale and are based on the total order value.

Special Orders

For special orders and non-standard products:Prices for these items and delivery details will be quoted for at time of acknowledgement of the enquiry unless otherwise specified. The price quoted will be held for 48 hours subject to the currency market price not increasing by more than 5 per cent of the currency market price on the date of the initial quotation, in which case we shall be entitled to provide a new quotation taking into account this increase.

Representation and Specification of Goods

Products displayed on our website will not be shown to actual scale or binding as to detail, and your attention is drawn to the item description where specific product details are given. This information is given in good faith but total accuracy cannot be guaranteed. Due to the huge selection and variety of choice it is not possible to show all variations, therefore, some images may be composite and some are representative only. Due to the limitations of colour display your screen may not show exactly the correct colour of the product being viewed. It may be necessary in extreme circumstances to supply a similar product of equal or superior specification where the item requested is not available at the time of order. All products are offered subject to availability.

Terms of payment

If you wish to pay for your selection by credit/debit card, you will be charged for your selection of goods at the time of placing your order. However products will not be dispatched to you until payment has been confirmed as valid and lawful and made in full. Other methods of payment are available (see below).

Methods of Payment

There are three methods in which you may pay for your selection of products:- By credit/ debit card - By cheque - By money order Netbanx transaction facilities are used where credit / debit card authorisation is required. Cards that are acceptable for use for payment are:- Master Card , Visa Credit Card, Visa Debit Card, Switch Card

Delivery

Your order will be processed immediately upon receipt and purchases will be dispatched with the minimum of delay but as stock levels vary by season please allow up to 28 days for delivery. An additional allowance of seven days is to be made for personalised items. For special orders and non-standard products: prices for these items and delivery details will be quoted for at the time of acknowledgement of the enquiry unless otherwise specified. For the avoidance of doubt, time shall not be of the essence in respect of delivery of your purchases. Royal Mail Special Delivery Service will deliver all dispatched items on Mainland Britain and Swift Air or similar courier service for elsewhere. This will require a signature upon receipt; do not worry if no one is in as the courier will leave a note regarding alternative collection / delivery arrangements. The Punch Clinic will only deliver parcels to the purchasing credit card holders address and on delivery the parcel is to be signed for only by this cardholder. We will not be held responsible for the parcel if signed for by anyone else. Other methods of payment are available for delivery to a different recipient or different delivery address. However, dispatch will not occur until full payment or confirmation of cheque clearance is received. We shall be under no liability for any delay in delivery or non-delivery due to circumstances beyond our control. If the parcel / product is lost or found to be damaged upon receipt then Royal Mail and The Punch Clinic must be informed without delay and any damaged item(s) returned to us for replacement. Packaging

All items will be suitably packaged to prevent damage in transit. All returned items must be sent in original box and wrapped in protective packaging to prevent damage during return transit along with all attached documentation and paperwork. This is the customers responsibility. See below for our Returns Policy.

Insurance

The Punch Clinic provides product insurance to items whilst in transit delivery only up to the point of customers signed receipt. It is the customers responsibility for appropriate insurance cover thereafter.

Special Orders

Special Orders fall into two categories: bespoke and outsize. These items are subject to a restricted returns policy. See our Returns Policy below.

Special Offers

Any special offers by The Punch Clinic from time to time are made strictly on the following conditions: No cash alternatives Subject to availability Not available in conjunction with any other offer Offer limited to one offer per Registered Customer

Returns Policy

In the event that any product ordered does not fit the recipient, such item may be returned to us within seven days immediately after the date of the relevant signed delivery receipt and exchanged for identical product of a different size. Alternatively, if you are dissatisfied with your purchase you may return it to us in its original unworn condition (trying for size excepted) within seven days immediately after signed receipt date. When we have received the item(s) we will refund you the full cost of product(s) but not the cost of postage. You are liable for postage and insurance costs back to The Punch Clinic using the recommended method of postal return, as below. It would be helpful in developing our Customer Care if you would enclose a note regarding your reason for return. Any item which has been specifically personalised, names or any other form of text or symbols or bespoke design, will not be eligible for the same return policy as other non-personalised items. If the parcel / product is lost or found to be damaged upon receipt by you, i.e. whilst in transit, then both the Royal Mail and The Punch Clinic must be informed without delay and any damaged item(s) returned to us for replacement within seven days immediately after the date of the relevant signed delivery receipt. The Punch Clinic shall not be deemed in breach of its obligations provided replacement products have been supplied. Although unlikely, should an item fail to correspond with specification or show a defect in material or workmanship we will gladly exchange or refund on return of the faulty product(s) within twelve months from delivery. The Punch Clinic will use its own discretion in replacing these damaged goods and we will not credit or replace items that have been ill treated or suffered damage through normal wear and tear. Before returning any product(s) you must contact the sales office to obtain a return number, which must be clearly marked on the back of the parcel. The returned product(s) must be date receipted, must be sent in original box and wrapped in protective packaging to prevent damage during return transit along with all documentation and paperwork. This is the customers responsibility. It is the customers responsibility for appropriate insurance cover to be obtained when returning goods to The Punch Clinic and the use of Royal Mails Special Delivery is strongly recommended for returns on mainland Great Britain and the use of an equally reliable courier service when being returned from elsewhere. Please remember the goods belong to you until we receive them.

Liability

The Punch Clinic gives no warranty or representation as to the accuracy, suitability or reliability of the information or content of the website for any purpose. Any such information or content is provided on an "as is" basis without warranty of any kind and, except where the website is being used by a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties and conditions (including all warranties and conditions implied by law as to title, satisfactory quality, fitness for purpose and non-infringement) are expressly excluded in this respect. We do not accept liability for any typographical, clerical or other errors and/or omissions and reserve the right to add, delete, and modify any of the information found on the web site at any time without notice. Subject to the following provisions The Punch Clinic warrants that any products supplied will correspond with any applicable specification at the time of delivery and will be free from defects in material and workmanship for a period of twelve months from delivery. This warranty is given subject to the following conditions: (a) The Punch Clinic shall be under no liability in respect of any defect in the products arising from any specification or instructions by you or errors or inadequacies in the same; (b) The Punch Clinic shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage or alteration or repair of products without our approval; (c) the above warranty does not extend to products not manufactured by The Punch Clinic in respect of which you will only be entitled to the benefit of any such warranty or guarantee as is given by the manufacturer to ThePunchClinic.com Subject as expressly provided in these Terms and Conditions, and except where products are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law in respect of any products supplied by The Punch Clinic. Where we have replaced defective products or products failing to meet specification, or refunded to you the price of such products (or a proportionate part of the price), The Punch Clinic shall have no further liability to you. Except in respect of death or personal injury caused by our negligence, or liability for defective products under the Consumer Protection Act 1987, The Punch Clinic shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law or under these Terms and Conditions for loss of profit or for any indirect, special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of The Punch Clinic, its employees or agents or otherwise) which arise out of or in connection with the supply of products (including any delay in supplying or any failure to supply products in accordance with these Terms and Conditions or at all) or their use or re-sale by you and the entire liability of The Punch Clinic under or in connection with the supply of products shall not exceed the price of the products. The Punch Clinic shall not be liable to you by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products, if the delay or failure was due to any cause beyond our reasonable control.

Jurisdiction, Entire Agreement and Severability

Every purchase you make shall be deemed performed in England. English law shall govern these Terms and Conditions and every aspect of contractual agreement concerning purchases made from us and ThePunchClinic.com and the customer submit to the non-exclusive jurisdiction of the English Courts. These Terms and Conditions and Privacy Policy contain the entire agreement between you and The Punch Clinic relating to your purchase and supersede all previous agreements and understandings between us. The invalidity or enforceability of any term shall not affect the validity or enforceability of any of the other terms. All products sold by The Punch Clinic shall remain the property of The Punch Clinic until payment of the total product invoice amount. You undertake that all details you provide us for the purpose of ordering or purchasing products (including any applicable specification) are correct, that the credit or debit card you are using for the purpose of ordering or purchasing products is your own and that there are sufficient funds to cover the cost of the product or service being purchased. If there are any changes to the details supplied to us by you it is your responsibility to inform The Punch Clinic within a reasonable period after supply of such details. We shall have no liability to you arising from your failure to do this. Confirmation of receipt of your order by e-mail, does not guarantee the product sale. For credit card purchases your account will be charged for the products selected with the prices displayed at the moment of your order acceptance. For all other methods of payment orders will commence manufacture process on credit clearance confirmation.
